Is The Two-Gallon Fill-Up Fee a Scam?

When FlyerTalk member Foob recently rented from Dollar Rent-A-Car and filled up the tank of the rental car before returning it to the airport in Boston, the desk clerk pointed out that the tank of the car was refueled 12 miles from the airport.
Apparently, the rule is that one must fill up the gasoline tank within 10 miles of the airport or be charged a two-gallon fee — which, in this case, amounted to approximately $8.00.
Foob claims that the rental car got much more than 10 miles per gallon. Is this charge legitimate or a possible scam? What can be done to prevent this fee from being incurred? Is there a better way?
