This case alleges that American Airlines breached its contract with certain customers who were incorrectly charged fees by charging them to check one or more of their bags — despite promises that they could do so at no additional cost. When customers purchase tickets from American Airlines for air travel, a contract is formed in which the airline promises certain customers that they can check a certain number of their bags at no additional charge — depending on the route of travel, cabin of service, frequent flier elite level status, or other reasons.

This settlement resolves the lawsuit; and who is right has not been decided by the court. The settlement class consists of all residents of the United States — including all fifty states, the District of Columbia, the United States Virgin Islands, and Puerto Rico.

If you are a member of this class action settlement, you are eligible to receive a refund of 100 percent of all incorrectly charged baggage policy bag fees during the case timeframe — plus interest; as well as a refund of 75 percent of incorrectly charged confirmation e-mail bag fees.

Any member of the settlement class who was incorrectly charged to check his or her bag or bags on multiple different occasions is eligible to receive a refund for each of those charges.

Each incorrect baggage charge will only be refunded once. For example, if you should have been entitled to check a bag at no charge both because you had elite frequent flyer status and also because you purchased a ticket in a premium cabin, you may only recover the overcharged amount for that bag once.

Refunds will be calculated based on the following:
