Your Laptop Computer and Mobile Telephone May Be Seized By Customs Agents Without Warning, and for No Reason

Imagine that you are an international traveler returning to the United States, only to have a customs agent impound your laptop computer and copy your hard disk drive without your consent or permission, and — at least for now — there is not a thing you can legally do about it as it happens.

Some critics, such as the American Civil Liberties Union — or ACLU — argue that the Fourth Amendment of the Constitution of the United States of America is being violated, yet the policy of searching electronic devices and equipment is justified and defended by the United States Department of Homeland Security under the relatively new Privacy Impact Statement. As a result, the American Civil Liberties Union has allegedly filed a lawsuit against the Department of Homeland Security under the Freedom of Information act.
